1. About these terms

These terms apply to your use of fondkeep.com and to any order you place with us. By placing an order you agree to them.

Fondkeep is a trading name of NQ Global Commerce LLC, a limited liability company registered in the State of Montana, United States, with its registered office at 1001 S Main St, Ste 600, Kalispell, Montana 59901, United States. In these terms, "we", "us" and "our" refer to NQ Global Commerce LLC, and your contract of sale is with that company.

2. Products and personalization

Our products are made to order and personalized with content you supply, such as names, dates, messages and photographs. Product images on the site are examples; because items are handmade, small variations in grain, color and finish are normal and are part of the character of the product.

3. Content you upload

By uploading a photograph or text you confirm that you own it or have permission to use it, and that it does not infringe anyone else's copyright, trademark or privacy. We use your content only to produce your order and we delete production files after a reasonable period.

We reserve the right to refuse and refund any order containing content that is unlawful, hateful, sexually explicit, or that appears to infringe someone else's rights. We will always contact you before cancelling for this reason.

4. Prices and payment

All prices are shown in US dollars and exclude any import duties charged by your own country. Prices may change at any time, but a change will never affect an order you have already placed. Payment is taken in full at checkout. We accept the payment methods displayed at checkout.

5. Orders

An order is confirmed when we send you an order confirmation email. We may decline or cancel an order if the item is unavailable, if there is an obvious pricing or description error, or if we suspect fraud. If we cancel, you receive a full refund.

6. Cancelling or changing an order

You may cancel or change your order within 12 hours of placing it, provided production has not started. After production begins, a personalized item cannot be cancelled or altered because it cannot be resold. This does not affect your rights where an item is faulty, damaged or does not match its description.

7. Delivery, returns and refunds

Delivery timeframes and shipping costs are set out in our Shipping Policy. Your rights to a remake or refund are set out in our Return and Refund Policy, including our 45-day promise. Both policies form part of these terms.

8. Accuracy of the information you give us

You are responsible for the spelling, dates and images you submit and for the delivery address you enter. We reproduce personalization exactly as supplied. Please review your preview before completing checkout.

9. Intellectual property

All text, images, designs and code on this site belong to NQ Global Commerce LLC or our licensors and may not be copied or reused without written permission. You keep all rights in the photographs and text you upload, and you grant us a limited licence to use them solely to produce and deliver your order.

10. Accounts and acceptable use

If you create an account you are responsible for keeping your login details secure. You agree not to use the site to break the law, to interfere with its operation, or to extract data by automated means.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect losses, including missed occasions caused by carrier delays outside our control. Nothing in these terms limits liability that cannot be limited by law, including liability for death, personal injury or fraud.

12. Governing law

These terms are governed by the laws of the State of Montana, United States, and any dispute will be handled by the courts of that state. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protection rules of your own country.

13. If part of these terms cannot apply

If any provision of these terms is found to be unenforceable, the remaining provisions stay in full effect.

14. Changes and contact

We may update these terms from time to time. The version published on this page at the time you order is the version that applies.
